TERMS OF USE

SCOPE OF APPLICATION

Any Internet user creating an account is considered a User of ScienceLeadR. These Terms of Use (TERMS OF USE) apply to both member Users who have a partner offer or paid subscription or who belong to an organization with a paid subscription, and to non-member Users. All Users must therefore comply with these TERMS OF USE and the Privacy and Cookie Policy.

For Member Users, in addition to the policies and guidelines of the User’s employing organization, the User agrees to abide by these rules of conduct, which are intended to ensure responsible use of ScienceLeadR.

ScienceLeadR may only be used by healthcare professionals. If you are not a healthcare professional, you are not authorized to access or use ScienceLeadR.

SHARING RULES

ScienceLeadR allows messages to be sent and information to be shared in multiple ways, including through the Account. Shared information and content may be viewed by other member and non-member Users, visitors or third parties. ScienceOne respects the preferences that the User selects in the settings regarding the visibility of content and information.

EXCLUSION

ScienceOne is not a backup and storage service. ScienceOne does not undertake to maintain or provide a copy of the information or Transmitted Information, except as required by law as described in the Privacy Policy.

RULES OF CONDUCT

The User is prohibited from:

  • Disguise your identity, impersonate another person;
  • Communicate false information in your profile or about any person or organization;
  • Create, disseminate, share, or relay content that is illegal, fraudulent, deceptive, abusive, discriminatory, defamatory, invasive of privacy or of the protection of children and young persons; or harmful in any way that promotes or encourages violence, violation of laws, injury to dignity or physical integrity, eating disorders, suicide or drug abuse;
  • Violate confidentiality, medical or professional secrecy;
  • Infringe the intellectual property rights of ScienceOne or any other third party;
  • Disseminate sensitive personal information within the meaning of the General Data Protection Regulation and in particular personal health data. ScienceOne is not a service provider or subcontractor authorized to receive and host health data;
  • Disseminate data or content that infringes on official or unofficial trademarks or company names;
  • Distribute, share or relay commercial, advertising, promotional or propaganda messages;
  • Create, post, share or relay content that may infringe copyright, trademark, or database rights;
  • Disclose information that you do not have permission to disclose (such as personal data of others, including your employer);
  • Interfere with the proper working of ScienceLeadR;
  • Access ScienceLeadR using another User’s Profile without the User’s express permission; when a User authorizes a third party to log in from his or her Profile, the User is advised that the third party has access to the User’s data and may act on the User’s behalf;
  • Access ScienceLeadR and its contents by means not authorized by ScienceOne; attempt to circumvent or bypass access controls and security measures;
  • Import viruses, malicious programs, or code, or do anything else that could damage, disable, overburden or impair ScienceLeadR (such as a denial-of-service attack or interference with page display or other functionality);
  • Develop, support, or use any software, device, script, robot, or other means or process to engage in web scraping or data copying;
  • Divert messages by any means;
  • Reverse engineer, decompile, disassemble, decipher, or otherwise attempt to obtain the source code of ScienceLeadR;
  • Pretend to represent ScienceOne or to be a partner without rights;
  • Licensing, marketing, selling, or monetizing rights to or access to
    ScienceLeadR or related data without rights;
  • Create deep links to ScienceLeadR for any purpose other than promoting your Profile, without the consent of ScienceOne;
  • Use framing, mirroring, or any other technique intended to simulate the appearance or operation of ScienceLeadR.

The User may report to ScienceOne any information that he or she believes violates these TERMS OF USE by writing to corporate@scienceone.eu.

SCIENCEONE’S POWER OF SANCTION

ScienceOne may restrict access to non-member Users at any time in the event of non-compliance with the prohibitions set forth above or when access is deemed to be non-compliant.

ScienceOne will review the data and may remove or limit access to it if it violates these TERMS OF USE, the Agreement with the User, or its organization. ScienceOne will notify the User or its organization within a reasonable time if such action is necessary.

However, certain data or public messages are moderated after the fact (a posteriori).

INTELLECTUAL PROPERTY

The ScienceLeadR platform as well as part of its content is protected by copyright and trademark law.

The User undertakes to respect the property mentions appearing on ScienceLeadR,

The rights relating to these elements are reserved to their holders. Consequently, any reproduction, representation, use, adaptation, modification, incorporation, translation, commercialization, partial or integral by some process and on some support that it is, are prohibited without the preliminary written authorization of the holder, subject to the exceptions aimed at the article L.122.5 of the Code of the intellectual property, under penalty of constituting an offence of counterfeit.

LIMITATIONS OF LIABILITY

ScienceOne shall not be liable for any technical problems encountered on ScienceLeadR with respect to non-member Users,

The existence of a link to another third-party site does not constitute an endorsement of that site or its content by ScienceOne. Furthermore, ScienceOne shall not be liable for any problems encountered on this other site or for any information published on this site, nor for the consequences of their use.

Each User is liable for the information and data he/she shares on ScienceLeadR. ScienceOne shall not be liable for such information and data.

In addition to the terms described in the Agreement for Member Users, ScienceOne makes no warranties, even implied, regarding the Services to Non-Member Users.

PERSONAL PROFILE DATA

Personal Profile Data is governed by the Privacy Policy. User agrees that ScienceOne may access, store, process and use the personal information and data provided in accordance with the terms of the Privacy Policy. The User agrees that the Profile Data existing or shared by the User shall become part of the ScienceLeadR database. User grants ScienceOne a non-exclusive, perpetual, worldwide, royalty- free right to use User’s Profile Data solely for the purpose of providing ScienceLeadR. User shall ensure (a) the accuracy and completeness of his or her Profile data; (b) that he or she obtains all necessary rights and consents required by law from persons to share the information he or she shares and that will be processed by ScienceLeadR.

The User is solely liable for any decision to share data with other Users or with third parties. Finally, ScienceOne is not liable for the use, viewing, modification, distribution, or deletion of User’s data by persons whom User has authorized to take such actions.

Manage file synchronization

Since one file can be synced with multiple locations, you can list and manage synchronized locations by clicking File synchronization in the Synchronize sub-menu. This allows you to list and remove synchronized locations that are linked to your file.

ACCOUNT

Accounts are individual. The User chooses a strong password that he keeps secret. The User is liable for all use of his account except fraudulent use by a third party. The account belongs to the User. However, if the paid version of ScienceLeadR is subscribed by your employer or an organization on behalf of the User, the ScienceLeadR Customer has the right to control access to the paid ScienceLeadR and to obtain reports on its use, but it has no rights to the personal account.

NOTIFICATIONS

The User accepts notifications and messages from ScienceLeadR and the contact information provided. User may set preferences to control and limit notifications.
